Abstract:

In today's stock markets, capital market instruments are in-vested in various ways. In this context, many transactions are used as investment instruments. Each transaction is handled on a certain legal basis. Both theoretically and practically, it is important to determine the functioning of these applications, which have an important place in terms of Islamic economic studies. In order to evaluate the applications realized within the body of the stock exchanges in terms of the fiqh, which are a part of economic life, the fiqh issues of each application should be determined and examined within this framework. One of the transactions applied in the stock market is short selling. The short selling process, like other applications, includes many fiqh issues. Therewithal, it is an important issue that needs to be examined in terms of its function and effects on today's markets. Within the scope of the study, the implementation of the short selling process and the fiqh issues it contains will be determined and the process will be evaluated in terms of fiqh.
