Abstract:

The Constitution amendment adopted by the public vote of 16.04.2017 and implemented by Law No. 6771 was passed from the parliamentary system in Turkey to the presidency government system. Amendments made by the President elected by the people on 09.07.2018 have entered into force. The new presidential system in the center of the presidential system has its own aspects. In this system, the principle of separation of forces is more rigorous than the parliamentary system. But the principle of separation of forces can be effective depends on the ability of state bodies to control and limit each other. The system of separation of forces is a system aimed at preventing the dictatorship of political power. The failure to properly establish or properly operate the balance and control mechanisms in this system leads to the degradation of individual freedoms. Therefore, in the presidency system, it is also of great importance for the interests of society and individual freedoms in which the state organs interact with each other. How the legislative, executive and judicial bodies are established and interact with each other constitute the core aspects of the system. Parliamentary elections and the structure of the presidential elections, the presidential decisions, the appointment of members of the Constitutional Court are many aspects of the principles of separation of forces. This study also examined what the principle of division of forces is, how it emerged and developed, and later the balance and control mechanisms in the presidency system were evaluated according to this principle.
