Abstract:

Debt restructuring contracts are intended to enable debtors in economic distress to pay their debts. In this way, creditors have the opportunity to collect their debts according to the restructuring plan. However, some of the debts were subject to enforcement proceedings before the restructuring. The debt may be restructured before the annulment of objection proceeding is filed, or it may be restructured after the annulment of objection proceeding is filed. In both cases, this study discusses the effects of the restructuring agreement on the annulment of the objection. According to these effects, it is discussed whether it is possible to decide on the execution denial indemnity in favor of the creditor or the debtor.
