İnsanoğlunun varoluşundan beri korunma amaçlı başlayan barınma ihtiyacı, zamanla yaşam hakkı içerisinde yer alan bir olgu haline gelmiştir. Bireylerin insan onuruna yakışan bir yaşam sürebilmeleri için Birleşmiş Milletler İnsan Hakları Evrensel Bildirgesi ve birtakım sözleşmeler, barınma ve konut hakkından bahsetmiştir. Türkiye’de de konut hakkına dair bir takım mevzuat çalışmaları yapılmıştır. Cumhuriyetin kuruluşundan itibaren, orta ve alt gelir gruplarının desteklenmesi ve korunması, belirli dönemlerde sosyal devlet anlayışı olgusu ile sağlanmıştır. Bu bağlamda 1961 ve 1982 Anayasalarında, konut hakkını ifade eden maddelere yer verilmiştir. Bunun yanı sıra konut kavramı son dönemlerde kavramsal değişikliğe uğramış, bir hakla beraber bir meta haline dönüşerek ekonomik bir göstergeye dönüşmüştür. Bu sebeple, konut duvarlarla örülü fiziki mekân dışında ekonomik değeri olan yapı olarak da algılanmaktadır. 2021 yılının sonlarına doğru dünya genelinde yaşanan ekonomik kriz, döviz fiyatlarındaki yüksek artış ve buna paralel olarak konut yapımında artan maliyetler sonucunda dar gelirliler için insan onuruna yakışan bir konuta erişim neredeyse imkânsız hale gelmiştir. Bu çalışmanın amacı küresel ekonomik krizler dolayısı ile yapım maliyetleri artan konuta erişim hakkının ne derece kullanılabildiğinin tartışılmasıdır. Çalışmada konut hakkının, diğer kentsel haklar ile karşılaştırıldığında, herkes için eşit bir şekilde uygulanmasının mümkün olmadığı, bu hakkın uygulanmasının, devletlere maliyetli olduğu ve konut hakkının kullanımı yerine politikalar geliştirilerek barınma sorunlarının çözülmeye çalışıldığı ortaya koyulmuştur. Sonuç kısmında konut hakkının anayasal bir hak değil, insan hakkı olarak algılanması için gerekli yasal düzenlemelerin yapılması gerektiği belirtilmiştir.
The need for shelter, which started for the purpose of protection since the existence of human beings, has become a phenomenon within the right to life in time. For individuals to lead a life worthy of human dignity, the United Nations Universal Declaration of Human Rights and some conventions have mentioned the right to shelter and housing. Several legislative studies on the right to housing have also been carried out in Türkiye. Since the foundation of the Republic, the support and protection of middle and lower-income groups have been provided by the concept of social state in certain periods. In this context, articles expressing the right to housing were included in the 1961 and 1982 Constitutions. In addition, the concept of housing has undergone a conceptual change in recent years and has turned into an economic indicator by turning into a commodity with a right. For this reason, the house is perceived as a building an economic value apart from the physical space covered with walls. Towards the end of 2021, due to the worldwide financial crisis, the high increase in foreign exchange prices, and the related increasing costs in housing construction, it has become almost impossible for low-income people to access a decent home. This study aims to is to discuss to what extent the right of access to housing, whose construction costs have increased due to global economic crises, can be used. In the study, it has been revealed that when compared to other urban rights, it is not possible to apply the right to housing equally for everyone, that the implementation of this right is costly to the states and that the housing problems are tried to be solved by developing policies instead of using the right to housing. In the conclusion part, it is stated that necessary legal arrangements should be made so that the right to housing is perceived as a human right, not a constitutional right.
