Article § 16a JGG (Youth Courts Act) on the detention of young people, which was brought in addition to the German Youth Courts Law, created a lot of controversy both in science and practice, as well as in politics and media. The focus of these discussions was the advantages and disadvantages of the new legal regulation in criminal law for youth courts. Extensive research was conducted to shed light on these discussions. The pros and cons of this new application were brought together for an empirical verification as a result of an experimental research project conducted by the German Federal Ministry of Justice and Consumer Protection and attended by 16 State Ministries of Justice in the 4 years since the application. Thus, data on the results and problems encountered in practice of this new regulation, which was partially prejudiced in politics and media, could be collected. In this article, the results of this experimental research and the criticisms of the authors in the literature are discussed in a comparative manner.
