Türkiye ile Avrupa Birliği “AB” arasındaki gümrük birliği, çeşitli nedenlerle güncellenme ihtiyacı içindedir ve bu amaçla resmi müzakerelere konu olmak üzeredir. Bu çalışma, gümrük birliğinin güncellenmesinin “yöntemi” ve yönteme bağlı “usulü” özellikle AB boyutuyla ve “tarım”, “hizmetler” ve “kamu ihaleleri” örnek alanları üzerinden incelemeyi amaçlamaktadır. Bu çalışma, hukuken ve siyaseten mümkün olduğu ölçüde, Ortaklık Konseyi Kararı yönteminin ve böylece AB açısından salt Konseyin nitelikli çoğunluk ile karar almasının sağlanmasının, özellikle birtakım AB üyesi devletin Türkiye karşısındaki olası negatif tutumları hesaba katılırsa, Türkiye açısından en uygun yol olacağını ortaya koymaktadır
The customs union between Turkey and the European Union “EU” is in need of modernisation for various reasons and therefore it is on the way to be subject of formal negotiations. This article seeks to examine the “method” and “procedure” dependent on this method for the modernisation of the customs union, especially from the aspect of EU and through sample areas of “agriculture”, “services” and “public procurement”. This article presents that, as long as possible both legally and politically, the method of Association Council Decision and thereby ensuring that regarding EU just the Council takes a decision with qualified majority, will be the most appropriate route for Turkey, especially if the potential negative attitudes of some EU Member States against Turkey are taken into account
