So many results that aren't mine?

1982 Anayasası süreç içerisinde pek çok değişikliğe uğramıştır. Bu değişikliklerin en kapsamlısı ise 16 Nisan 2017’de yapılan referandum ile gerçekleştirilmiştir. Burada ise dikkatimizi özellikle Cumhurbaşkanlığı Kararnamesi çekmektedir; zira değişikliklerin temel noktasını hükümet sistemi ile birlikte Cumhurbaşkanına tanınan kararname yetkisi teşkil etmektedir. İşte bu makalede yeni hükümet sistemi ekseninde Cumhurbaşkanlığı Kararnamesi tüm boyutlarıyla incelenmektedir. Buna göre makalede ele alınan temel sorun yürütme erkinin düzenleyici işlem yapma yetkisinde temel bir değişimin söz konusu olmasıdır. Değişimin odak noktası Cumhurbaşkanına kararname çıkarma yetkisinin verilmesidir. Kararname yetkisi ise norma koyma gücünü ifade etmektedir. Oysaki kuvvetler ayrılığının bir gereği olarak norma koyma tekeli bu anlamda asli yetkiye sahip parlamentoya aittir. Aksi halde norma koyma ve bunları yürütme yetkisi tekilleşir ve tekelleşir. Bu durum da hükümet sisteminde denge ve denetim mekanizmasını bozmaktadır. İşte çalışmamız özel olarak bu asli sorunu ve genel olarak buna bağlı diğer tali sorunları kaleme almaktadır.

Abstract:

In 1982, the Constitution had made many changes. The most comprehensive of these changes was made by a referendum held on 16 April 2017. Here, however, our attention is attracted by the Presidential Decree, since the main point of the changes is the decree authority recognized to the President along with the government system. In this article, the new government system in the axis of the Presidential Decree is examined in all dimensions. According to this, the main problem addressed in the article is that the man's authority to perform the regulatory process is subject to a fundamental change. The focus of the change is to give the President the authority to draft a decree. The power of ordering means the power of setting the norm. As a reason for the separation of the forces, the unit of setting the norm belongs to the parliament with the original authority in this sense. Otherwise, the authority to set the norm and implement it will be unified and unified. This also disrupts the balance and control mechanism in the government system. Here is our work specifically addresses this original problem and generally related other wire problems.

1982 Constitution has been amended numerous times. The most comprehensive amendment was made with the referendum held on 16 April 2017. The most remarkable aspect of this amendment is the Presidential Decree; main points of such amendments are the government system and authorization granted to the President for issuing decrees. This study focused on all dimensions of the Presidential Decree based on the new government system. In this context, the main problem addressed on the study is the fundamental change in connection with the regulatory power of the executive power. Focal point of the amendment is the granting of the power to issue decrees to the President. Power to issue decree represents power to introduce norms. However, monopoly of introducing norms belongs to the parliament that has the original power on this matter, as a requirement of the separation of powers. Otherwise, power to introduce norms and executing them would be singularized and monopolized. This situation disturbs the balance and control mechanism in the government system. The present study addresses this main problem and general aspects of other secondary problems.
