Abstract:

In both Islamic law and civil law, marriage must have both permanent and temporary barriers to validly occurring. These obstacles are due to a number of qualities that individuals carry. If there are temporary barriers to marriage, a ban on marriage occurs for a certain period of time, and the marriage cannot be performed as long as these barriers exist. Turkish civil law, just like Islamic law, gave great importance to the creation of a healthy marriage, carefully regulated every stage of marriage; it aimed to ensure that the marriage was on solid foundations. It is of religious and legal and vital importance to know the temporary barriers to marriage, which constitute one of the most important universal and continuous institutions that will never accept discussion of its place and importance in public life, and the most important preliminary problem to be solved accordingly. Especially with strangers marriage is on the rise today, when the difference of religion marriage marriage as a preliminary issue to be considered a temporary disability resulting from the end of prohibition that will occur in the event of re-marriage for people who want to make that need to be considered in terms of both law and Religious concern.
