Mutlu fertler, huzurlu aileler, sağlam ve güvenli toplumların inşası için dinin katkısı ve yol göstericiliği inkâr edilemez. Çünkü dinî hükümlerin bir amacı da kişinin can ve vücut bütünlüğünü korumak ve muhafaza etmektir. Bu nedenledir ki Şâri‘, Kur’ân-ı Kerîm’de ancak kendisine ibadet edilmesini, hiçbir şeyin O’na ortak koşulmamasını, anne ve babaya karşı sorumlulukların yerine getirilmesini, onlara karşı saygılı, şefkatli, merhametli ve mütevazı davranılmasını emretmiştir. Bu bağlamda anne ve babayı üzecek, kalplerini kırabilecek olan en hafif söz dahi haram sayılmıştır. Hz. Peygamber de (s.a.v.) anne ve babaya karşı işlenen suçların ve hukuka aykırı fiillerin cezalarının henüz dünya hayatında iken karşılık bulmaya başlayacağını bildirmişlerdir. Zira kişinin varlık dünyasına gelmesinde anne ve babasının etkin işlevleri, dünyaya gelişinden sonra da gelişip yetişmesi için sarf ettikleri üstün emeklerine rağmen maalesef anne ve babaya karşı işlenen hukuka aykırı ve müessir fiillerin gittikçe çoğaldığı bir durum oluşmaya başlamıştır. Bu çalışmada İslâm hukukuna göre ebeveyne karşı işlenen kasıtlı cinayetlerin hukukî neticeleri açıklanacaktır.

In this context, even the mildest word that could upset them and break their hearts was deemed haram. The Prophet (pbuh=peace be upon him) stated that the crimes against the parent and the punishments of illegal acts will start to find a response while they are still in the world life. Because, despite the effective functions of one’s mother and father in coming to the world of existence, and the superior efforts they made to develop and grow after his birth, unfortunately, a situation in which illegal and affective acts committed against the mother and father increase gradually has started to be formed. Here in this study, the legal consequences of intentional killings againts parents according to Islamic law will be explained.
