Amaç: Maluliyet raporları düzenlenirken farklı cetveller kullanılması sonucunda aynı kişi için farklı oranlar tespit edilmektedir. Bu çalışmada “Çalışma Gücü ve Meslekte Kazanma Gücü Kaybı Oranı Tespit İşlemleri Yönetmeliği (ÇGMKY)” ve “Engellilik Ölçütü, Sınıflandırılması ve Engellilere Verilecek Sağlık Kurulu Raporları Hakkında Yönetmelik (EÖY)” eklerindeki cetvellere göre hesaplanan maluliyet oranları karşılaştırılarak, cetvellerdeki farklılıkları ortaya koymak ve bilirkişilerin karşılaştıkları güçlüklere dikkat çekmek amaçlanmıştır. Yöntem: Olguların cinsiyet, yaş, meslek, travma orijini, travma türü, rapor isteyen kurumun istek yazıları, olaya bağlı yaralanmalar ve muayene bulguları olgu rapor formlarına kaydedildi. Her olgunun saptanan arızasına bağlı meslekte kazanma gücündeki azalma oranı ile engellilik oranı hesaplanarak arasındaki farklara neden olan etkenler değerlendirildi. Bulgular: Travma sonucu en sık olarak tibia, fibula ve vertebra yaralanmasının meydana geldiği saptanmış olup, eklemde hareket kısıtlılığının ve yürüyüş bozukluğunun en sık saptanan arızalar (%52) olduğu görüldü. ÇGMKY kapsamında sekel saptanan olguların yaklaşık yarısında (%48,1’inde) arızalarının A Cetveli’nde tam karşılığı bulunamadığından, takdir kullanımına gidildi. EÖY kapsamında ise 5 (%3,1) olguda takdiren indirime gidildi. Olguların hesaplanan engel oranı ortalamasının (%9,01), meslekte kazanma gücündeki azalma oranı ortalamasına (%15,14) göre anlamlı olarak (p<0,05) daha az olduğu görüldü. Sonuç: Olay tarihine göre değişen yönetmelik kapsamında farklı cetvellerin kullanılması, aynı arızaya/arızalara bağlı farklı engel/maluliyet oranlarının saptanmasına neden olarak mağduriyetlere yol açmaktadır. Maluliyet raporları konusunda yaşanan sıkıntıların, çözüm yollarının paylaşıldığı tıp ve hukuk alanında ortak bilimsel toplantılar düzenlenerek cetvellerin uluslararası standartlara uygun olarak güncellenmesi ve kavramsal birliğin sağlanması, raporların ortak kabul görmesi açısından önemlidir.
Purpose: The use of different cetvels during the preparation of materiality reports determines different rates for the same person. This study aims to compare the rates of property calculated according to the attachments in the "Arbeit and Occupational Profit Loss Rate Detection Procedures Regulation" and "Rules on Disability Measurement, Classification and Health Council Reports to be given to Disabled" and to identify the differences in the categories and to draw attention to the difficulties faced by the knowledgeers. Method: Sex, age, profession, trauma origin, type of trauma, request letters of the institution requesting report, injuries associated with the incident and examination findings were recorded in the incident report forms. The differences between the reduction rate of winning power in the profession related to the detected failure of each incident and the disability rate were calculated. The findings: The result of the trauma was found that the most frequently occurred the wounds of tibia, fibula and vertebra, and the most frequently detected defects of movement in the joint and walking disorder (52%). In the framework of the CGMKY, about half of the cases identified by the sequel (in 48.1%) failures were not found in the A Cetveli, it was used for appreciation. In the event, the 5th (3.1%) reduction was made. The calculated obstacle rate of cases (9.01%) was significantly lower than the average reduction rate of profitability in the profession (15.14%) (p<0.05). Conclusion: The use of different patterns within the regulations that vary depending on the date of the event leads to disadvantages as a result of the determination of different obstacles/deficiency rates associated with the same failure/deficiency. It is important that the difficulties in the field of materiality reports, the joint scientific meetings in the field of medicine and law where solutions are shared, and the update of the quatlets in accordance with international standards and the provision of conceptual unity, is important for the joint acceptance of the reports.
