Abstract:

The procedures and regulations concerning the recruitment of judges and prosecutors have always been controversial. We believe that the current legislative provisions related to this issue also pose some problems. The regulations and the procedure for the recruitment of judicial and administrative judges and prosecutors are comparable except for some differences regarding examinations and the courts where they do internship. The Law no. 2802 on Judges and Prosecutors applies to their recruitment. However, the recruitment of military judges and prosecutors is regulated by Law no. 357 on Military Judges. This study attempts to define the problems related to the recruitment of judicial, administrative and military judges and prosecutors, and to offer solutions to these problems where appropriate
