Yabancıların Türkiye’de eğitim hizmetinde çalışabilmeleri, başta 13 Ağustos 2016 tarihinde yürürlüğe giren Uluslararası İşgücü Kanunu (UİK) olmak üzere, diğer ilgili sektörel hukukî düzenlemelere tâbi tutulmuştur. UİK, 2003 tarihli 4817 sayılı Yabancıların Çalışma İzinleri Hakkında Kanunu (YÇİHK) yürürlükten kaldırmıştır. Çalışmamızda yabancı öğretim elemanlarının ve yabancı öğretmenlerin Türkiye’de çalışabilmeleri için kabul edilen usul ve esaslar, YÇİHK ile UİK karşılaştırılarak tespit edilmiştir. Şöyle ki, çalışma izni vermede yetkili makam veya ön izin alınma usulü gibi konularda UİK ile değişikliğe gidilmiştir. Ayrıca, yabancı öğretim elemanları ile yabancı öğretmenlerin Türkiye’de çalışabilmelerine ilişkin usul ve esaslar, tâbi oldukları UİK ve sektörel düzenlemelere göre de farklılık arz etmektedir.
The possibility for foreigners to work in education services in Turkey has been followed by other relevant sectoral legal regulations, including the International Labour Act (ILO), which entered into force on 13 August 2016. The UIC has repealed the Law No. 4817 of 2003 on Work Permissions for Foreigners. The procedures and principles accepted in our study for foreign teachers and foreign teachers to work in Turkey have been identified by comparison with UIK. Therefore, the authority of the work permit or the procedure for the provision of prior permission has been changed with the UIK. Furthermore, the procedures and principles regarding the ability of foreign teachers and teachers to work in Turkey are also different according to the UIC and industry regulations they follow.
