Health, illness and health care concepts show individual, social and cultural differences. Nevertheless the common consensus of the entire community is; health is a fundamental human right, all individuals should equally be able to benefit from this right and the adoption to provide this condition is the basic obligation of the welfare state. Health services are organized within the public service area providing obligations to the administration and rights to the individuals. The responsibility of the administration in case of damage to the individuals during the health service delivery is guaranteed by our Constitution. The liability defects of the administration in the context of health care will be discussed, in this study.
