Boğazlardan geçişle ilgili özel bir rejim olan Montrö Rejimi Türk Boğazlarının esasen milli boğaz olma özelliğini muhafaza eden ve günümüzde milletlerarası ulaştırmada kullanılan diğer boğazlardan geçiş rejimleri ile kıyasla boğaz devletinin yetkilerini asgari kısıtlayan bir rejimdir. Ayrıcalıklı bir rejim olarak ortaya çıkan Montrö’de Türkiye’nin güvenliği ön planda tutulmasıyla Boğazlar üzerindeki yetkisi esas, yetki kısıtlamaları istisna olarak kabul edilmiştir. Sözleşmenin uygulandığı yer dikkate alındığında Karadeniz güvenliği ile ilgili olarak kıyı devletlerin genel olarak çıkarlarını koruyan barış ve savaş zamanları için farklı düzenlemeler öngören bir sözleşme olarak bölgede yaşanan uluslararası uyuşmazlıkların seyrini doğrudan etkilediği görülmektedir. 2022 yılında başlayan Ukrayna-Rusya savaşı ile Türkiye’nin Montrö Boğazlar Sözleşmesi’nin savaş zamanı ile ilgili hükümlerini uygulaması bölgede NATO’nun hareket kabiliyetini sınırlamış, kıyıdaş devletler arasında yaşanan savaşı Karadeniz üzerinden yapılacak bir dış müdahaleden uzak tutmuştur. Bu çalışmanın amacı Montrö Rejiminin sui generis bir rejim olarak Karadeniz güvenliği üzerinde etkilerini, savaş halinde uluslararası toplum tarafından müdahale alanını daraltma nedenlerini, Türkiye’nin Karadeniz güvenliğinin sağlanmasında kilit bir rolü olduğunu ortaya koymaktır. Montrö rejiminin etkisinin anlaşılabilmesi için rejimin tabi olduğu uluslararası hukuk kurallarının incelenmesi gerekmektedir. Çalışmada Rejimin tabi olduğu kuralların savaş halinde olası bir müdahaleyi nasıl etkilediği, bölgedeki güvenlik aktörlerini tabi tuttuğu kısıtlamaların neler olduğu sorularına cevap aranacaktır. Bu nedenle öncelikle rejim kuralları hukuki statü, kapsam, devamlılık açısından değerlendirilecek sonrasında bu kuralların savaş zamanında nasıl uygulandığı ve Karadeniz güvenliğindeki önemi, NATO’nun 2014 yılından itibaren geliştirdiği yeni konsept ve devam eden Ukrayna- Rusya Savaşı örneği üzerinden açıklanmaya çalışılacaktır.
The Montreux Regime, which is a special regime related to the passage through the straits, is a regime that preserves the Turkish Straits as a national strait and limits the powers of the strait state to a minimum compared to the other straits transit regimes used in international transportation today. In Montreux, which emerged as a privileged regime, Turkey's authority over the Straits was accepted as the basis, and authority restrictions as an exception, with the security of Turkey at the forefront. Considering the place where the convention is applied, it is seen that it directly affects the course of international disputes in the region as a convention that envisages different arrangements for times of peace and war, which protects the interests of the coastal states in general regarding the security of the Black Sea. With the Ukraine-Russia war that started in 2022, Turkey's implementation of the wartime provisions of the Montreux Straits Convention limited NATO's mobility in the region and kept the war between the riparian states away from a foreign intervention over the Black Sea. The aim of this study is to reveal the effects of the Montreux Regime as a sui generis regime on Black Sea security, the reasons for narrowing the area of intervention by the international community in case of war, and Turkey's key role in ensuring the Black Sea security. In order to understand the effect of the Montreux regime, it is necessary to examine the rules of international law to which the regime is subject. In the study, answers will be sought to the questions of how the rules to which the regime is subject affect a possible intervention in case of war, and what restrictions are imposed on the security actors in the region. For this reason, first of all, the regime rules will be evaluated in terms of legal status, scope and continuity, then how these rules are applied in wartime and their importance in Black Sea security will be tried to be explained through the new concept developed by NATO since 2014 and the example of the ongoing Ukraine-Russia War.
