Lahey Milletlerarası Özel Hukuk Konferansı, Milletlerarası Ticarî Sözleşmelerde Hukuk Seçimine Dair Prensipleri 2015 yılında kabul etmiştir. Lahey Konferansının daha önce ortaya koyduğu metinlere kıyasen Prensipler, Konferans tarafından ortaya konulan bağlayıcı olmayan ilk hukuk aracıdır. Prensipler birden fazla ülkeyle bağlantılı ticarî sözleşmelerde hukuk seçimine dair kuralları içermektedir. Birkaç husus dışında, prensipler büyük ölçüde hukuk seçimi konusundaki ortak yaklaşımı yansıtmaktadır. Bununla birlikte, uygulanacak hukuk olarak anasyonel kuralların seçimine imkân vermesiyle benzer nitelikteki metinlerden farklı bir özellik göstermektedir. Bu çalışma Milletlerarası Ticarî Sözleşmelerde Hukuk Seçimine Dair Lahey Prensiplerinin amaçlarını, genel yapısını ve kapsamını inceleyerek, bu konuda bilgi vermeyi amaçlamaktadır.
The International Conference on Special Law in Lahai adopted the Principles of Law Selection in the International Trade Agreements in 2015. The Principles, compared to the texts previously presented by the Conference, is the first non-binding legal instrument presented by the Conference. The principles include the rules on the choice of law in trade agreements with more than one country. Apart from a few aspects, the principles largely reflect the common approach to the choice of law. However, the law to be applied is different from the text of similar quality as it enables the choice of anational rules. This study aims to provide information on this issue by examining the purposes, the general structure and scope of the Lahai Principles for Law Selection in the International Trade Agreements.
