Dava şartı arabuluculuğun kapsamının giderek genişlemesi ve TTK m. 5/A hükmündeki belirsizlik, çeşitli davaların arabuluculuğa ve dava şartı arabulu-culuğa elverişli olup olmadığını tartışmalı hale getirmiştir. Öte yandan Hukuk Uyuşmazlıklarında Arabuluculuk Kanunu m. 1, f. 2 hükmü gereği, bir uyuş-mazlığın arabuluculuğun konusunu oluşturabilmesi için, her şeyden önce onun üzerinde serbestçe tasarruf edilebilmesi gerekir. Buna karşılık iflâs, Türk hukukunda geleneksel olarak kamu düzenine ilişkin bir konu olarak kabul edilmektedir. İşte bu çalışmada, iflâs yargılamasının arabuluculuğa elverişli ve dava şartı arabuluculuk kapsamında kabul edilip edilmeyeceği tartışılmıştır. Bu yapılırken, giriş kısmında arabuluculuk yoluna ilişkin temel kurallardan ve iflâsın genel özelliklerinden yola çıkılmış, daha sonra konu, takipli iflâs ve doğrudan iflâs bakımından ayrı ayrı ele alınmıştır.
The extension of the scope of mediation and the uncertainty in the judgment of TTK m. 5/A have made it controversial whether the various cases are appropriate for mediation and the condition of the case is appropriate for mediation. On the other hand, in accordance with the provisions of Law on Mediation in Legal Disputes, p. 1, f. 2, a dispute must first and foremost be freely saved on it, in order that a dispute may form the subject of mediation. In turn, the bankruptcy is traditionally regarded as a matter of public order in Turkish law. In this study, it is discussed whether the fault judgment is appropriate for mediation and whether the condition of proceedings is accepted within the mediation. When this is done, the entrance section is based on the basic rules of the mediation path and the general characteristics of the bankruptcy, then the subject, followed bankruptcy and direct bankruptcy are discussed separately.
The application of the mandatory mediation rules to certain type of actions is a controversial topic, the scope of mandatory mediation becoming wider and the formulation of the article 5/A of Turkish Commercial Code being still uncertain. On the other hand, according to the Code on Mediation in Civil Disputes, article 1 paragraph 2, the civil dispute should be arised solely from an act or proceeding which the parties may freely dispose. However, bankruptcy is traditionally treated as an issue of public order in Turkish jurisprudence. In this study this matter is discussed whether the bankruptcy litigation is eligible to mediation and, it is also subject to mandatory mediation or not. In this context, departing from the main rules of mediation and the characteristics of bankruptcy, than, the question is analysed separately about the types of bankruptcy.
