Hüseyin Celal Yardımcı, çok partili hayatın ilk yıllarında siyasi davaların gözü pek avukatı olarak yeni kurulan Demokrat Parti’ye gönül vermiştir. 1950-1960 yılları arasında TBMM’de görev yapmıştır. Bu dönemde TBMM Başkanvekilliği, Devlet Vekilliği, Maarif Vekilliği ve Adliye Vekilliği görevlerinde bulunmuştur. 27 Mayıs 1960 darbesi sırasında tutuklanmış ve Yassıada’da yargılanmıştır. 14 Ekim 1960’da başlayan yargılama sırasında İstanbul ve Ankara Olayları, Radyo Davası, Kırşehir’in İlçe Yapılması, CHP Mallarına El Konulması, Hakim Teminatı ve Mahkeme Bağımsızlığının Kaldırılması, Tahkikat Komisyonu’nun Kurulması gibi davaları içeren Anayasayı İhlal suçuyla yargılanmıştır. Avukatlarının yanı sıra iyi bir hukukçu olarak mahkemede kendini başarıyla savunmuş ve partisinin icraatlarının arkasında durmuştur. Savcının ve mahkeme başkanının duruşmalar sırasında zaman zaman aşağılayıcı tutumları karşısında, yapılan hukuksuzlukları söylemekten çekinmemiştir. 203 gün süren yargılama sonucunda hakkında müebbet hapis cezası verilmiş ve Kayseri Cezaevine yollanmıştır. Yardımcı, 1965 yılında sağlık sorunları nedeniyle affedilerek özgürlüğüne kavuşmuştur. Bu çalışmada arşivden alınan belgelerin yanı sıra Yassıada Mahkemelerinin tutanakları, TBMM tutanakları, süreli yayınlar, araştırma eserleri ve anılar kullanılmıştır. Ağrı Mebusu Celal Yardımcı’nın Yassıada Mahkemelerindeki yargılanma sürecini incelemeye çalıştığımız bu çalışma nitel bir çalışmadır. Çalışmamızda yöntem olarak analiz ve karşılaştırma metodları benimsenmiştir. Giriş kısmında cumhuriyetin ilanından 1960 askeri darbesine kadar olan siyasal gelişmeler, çok partili hayata geçiş denemeleri, II. Dünya Savaşı sonrası demokrasi çabaları ve Demokrat Parti’nin iktidar yılları kısaca değerlendirilmiştir. Yardımcı’nın askeri darbeye kadar olan yaşam öyküsü inceleme konusu edildikten sonra Yassıada duruşmalarının tutanakları üzerinden yargılanma süreci ele alınmıştır. Bu çalışmada Yardımcı üzerinden askeri darbe sonrası Yassıada’da yapılan yargılamaların siyasal ve hukuksal boyutu da irdelenmeye çalışılacaktır.
Hussein Celal Assistant, in the first years of multi-party life, has given the eye of political cases as a very lawyer to the newly established Democratic Party. He served in TBMM between 1950 and 1960. During this period, TBMM has been in the functions of the Chairman, the State Department, the Maarif Department and the Justice Department. He was arrested during the May 27 1960 coup and sentenced to trial in Yassada. During the trial that began on October 14, 1960, Istanbul and Ankara were prosecuted for the violation of the Constitution, which included cases such as Istanbul and Ankara Events, Radio Case, Kırşehir's District Building, the Handling of the CHP Property, the Suppression of Judges and the Independence of the Court, the Establishment of the Arbitration Commission. In addition to his lawyers, as well as a good lawyer, he successfully defended himself in court and stood behind his party execution. During the trials, the prosecutor and the president of the court had not hesitated to say the unlawful behaviors made, in the face of the humiliating attitudes of time to time. After 203 days of trial, he was sentenced to life imprisonment and sentenced to Kayseri prison. He was sentenced to freedom in 1965 for his health problems. In this study, the documents obtained from the archive, as well as the Yassıada courts' statements, TBMM statements, periodic publications, research works and memories were used. This work that we are trying to investigate the process of judgment in the Yassıada courts of the Pain Mebusu Celal Assistant is a qualitative work. The analysis and comparison methods are used as a method. Political developments from the proclamation of the Republic to the 1960 military coup, attempts to transition to a multi-party life, II. The efforts of democracy after the World War and the years of the Democratic Party's power were briefly evaluated. After the life story of the assistant until the military coup was examined, the trial process was discussed on the basis of the attitudes of his trials in Yassıada. In this study, the political and legal dimensions of the trials in Yassyada after the military coup will also be attempted to be assessed by the Assistant.
