Kozmopolitanizm çeşitli dönemlerde farklı anlamlara bürünen bir kavramdır. En belirgin ifadesini ilk defa Stoacılarda gördüğümüz kavramın daha sonra özellikle Kant’ın düşüncesi içerisinde politikaya ve hukuka mal edildiğine tanık olmaktayız. Genel olarak bir dünya yurttaşı olmayı ifade eden kozmopolitanizmin bir etik ideal mi, bir politik proje mi yoksa hukuksal bir formülasyon mu olduğu tartışmalıdır. Bu makalede kozmopolitanizmin kriz zamanlarında ortaya çıkan, deneyimlenen krizin mahiyetine göre farklı çözümler sunan, akışkan ve değişken bir tavır olduğu ileri sürülmektedir. Bununla anlatılmak istenen kozmopolitanizmin somut bir proje ya da gelecekte gerçekleşmesi temenni edilen bir ideal değil, bazen bir etik tutum bazen bir politik proje ve bazen de hukuksal bir çözüm olarak pratik çözümler sunan bir tavır, bir yaklaşım biçimi olduğudur. Diğer yandan çeşitli kozmopolitan yaklaşımların birbiriyle kesişen en temel özelliği, bir krize yönelik çözüm geliştirme kapasitesidir. Bu makalenin amacı, Stoacı kozmopolis idealinin Kantçı kozmopolitanizm içerisinde nasıl dönüştürüldüğünü göstermek suretiyle, Kant’ın özgün çözümünden günümüze uzanan imkanları çekip çıkarmaktır. Bu amaçla öncelikle Stoacı kozmopolitanizm ile Kantçı kozmopolitanizmi birbirinden ayıran unsurlar ele alınmış, daha sonra doğal hukuk geleneği içerisinde Kant’ın kozmopolitan düşüncesinin sunduğu katkılar ele alınmış ve Kantçı kozmopolitanizmin hukuksal temelleri açımlanmaya çalışılmıştır.
Cosmopolitanism is a concept that has different meanings in various periods of history. The most obvious expression of the concept has firstly been shaped in the Stoics, and later attributed to politics and law, especially in Kant's thought. It is disputable whether cosmopolitanism, which generally refers to being a world citizen, is an ethical ideal, a political project or a legal formulation. This article argues that cosmopolitanism is a fluid and variable attitude that emerges in a time of crisis and offers different solutions according to the character of the experienced crisis. It means that cosmopolitanism is not a concrete project or an ideal to be realised in the future, but an attitude, an approach that offers practical solutions that sometimes become an ethical attitude, sometimes a political project, and sometimes a legal solution. On the other hand, the most fundamental feature that intersects with various cosmopolitan approaches is the capacity to develop solutions for a crisis. The purpose of this article is to deduce the possibilities from Kant's original solution to the contemporary problems by presenting how the Stoic ideal of cosmopolis transformed within Kantian cosmopolitanism. To the end that the elements distinguish Stoic cosmopolitanism from Kantian cosmopolitanism are analysed firstly and the contributions of Kant's cosmopolitan thought within the tradition of natural law are discussed by the legal foundations of Kantian cosmopolitanism.
