Ağrı İli sosyo-ekonomik veriler ışığında değerlendirildiğinde, Türkiye’nin kentleşme ve kamu hizmetleri bağlamında geri kalmış şehirlerinden biridir. Kentleşmenin nüfus yoğunluğu ile doğrudan ilişkisi genel geçer bir kriter olarak kabul görmektedir. Ağrı toplam nüfusu ile Türkiye’de iller sıralamasında 68. sırada yer almasına karşın, gelişmişlik sırlamalarında son üç il arasında yer almaya devam etmektedir. Toplu Konut İdaresi Başkanlığı (TOKİ), tarihsel süreçte birçok farklı devlet otoritesiyle eklemlenmesine karşın, hali hazırda Çevre ve Şehircilik Bakanlığı’na bağlı bir kuruluş olarak varlığını sürdürmektedir. Daha çok konut gereksinim oranı yüksek olan yerlerde vatandaşın konut ihtiyacını üstün ve ayrıcalıklı yetkilerle karşılamaya çalışan kurumun, temelde, vatandaşların gelir düzeylerine göre bir ayrım ile bu ihtiyacı karşılama politikası vardır. Ancak TOKİ, hiçbir surette bedelsiz konut verme uygulamasına gitmemiştir. İdare Hukukuna egemen ilkelerden biri olan, kamu hizmetlerinin sunumunda “kamu yararı” ilkesi çerçevesinde çalışması beklenen kurum, uygulamalarında özellikle orta ve alt gelir gurubuna yönelik konut temininde ne denli kamu yararı ilkesinin gözetildiği, bu çalışmanın da temel sorusudur. Bu anlamda oluşturulan hipotezin önermesi şudur: Devlet ve kamu kurumları hizmet sunumlarında kamu yararı ilkesi doğrultusunda hareket eder. Çalışma, Ağrı’da yapımı 2011 yılında tamamlanan ve aynı yıl kura ile belirlenen hak sahiplerine dağıtımı yapılan Suçatağı İkinci Etap, 3+1, 120 metrekare brüt oturma alanına sahip 228 dairenin (10 bina), TOKİ’ye maliyeti ile vatandaşa maliyeti arasında bir karşılaştırma yaparak, kamu açısından “kar mı, yoksa kamu yararının mı gerçekleştiğini” ortaya koymayı hedeflemektedir. Bu çalışma üç bölümden oluşmaktadır. Birinci bölümde TOKİ’nin kısa tarihçesi ve uygulamaları, ikinci bölümde “Kamu Yararı” kavramı, üçüncü bölümde ise Ağrı Suçatağı TOKİ Konutlarının arsa temini, yapım ve satış aşaması, rakamlar ve hesaplamalar eşliğinde ortaya konulmuş, çalışma genel bir değerlendirme ile sonuçlandırılmıştır. Ağrı Province, considered in the terms of socio-economic datas, is one of backward cities of Turkey in urbanization and lacked in public services. The direct relationship of urbanization with population density is accepted as a common criterion. Despite having rank of sixty eighth in total population of Turkey, in terms of development, it continues to be ranked among the last three provinces of Turkey. Although the Housing Development Administration (TOKI) has been integrated with many different state authorities in the historical process, it still exists as an affiliate member of the Ministry of Environment and Urbanization. The institution, which seeks to meet the housing need of the citizen with superior and privileged powers, has a policy of meeting this need with a distinction based on the level of income of citizens. However, TOKI has never been able to offer free housing. The institution, in principle, is expected to work within the framework of the “common good” within the provision of public services that is one of the dominant principles of Administrative Law. The extent of public interest principle that is taken into account during performing is an essential factor, especially, for middle and lower income groups. In this sense, the hypothesis created is:Governmentaland public institutions to what extent act in line with the principle of public interest, in service provision. The study was carried out in Ağrı. The project was completed in 2011 and was distributed to the right holders determined in the same year . By doing this, it aims to reveal whether gaining profit or ensuring public benefit are realized in terms of the public services. This study consists of three parts. In the first part, the short history of TOKI and its applications, in the second part, the concept of public benefit and in the third section, the provision of land development, construction process and liquidation stages were evaluated with figures and calculations related to Ağrı Suçatağı TOKİ Houses. In the light of socio-economic data, it is one of Turkey's cities behind in the context of urbanization and public services. The direct relationship of urbanization with the population intensity is considered a general passing criterion. Despite the total population of the pain in Turkey ranked 68th in the province ranking, it continues to be ranked among the last three provinces in the development ranking. The Chairman of the Public Housing Administration (TOKI) has been added to many different government authorities in the historic process, but the situation is currently still a organization affiliated with the Ministry of Environment and Urbanism. The institution, which tries to meet the citizen’s housing needs with superior and privileged powers in places with a higher housing demand rate, has a policy to meet this need, basically, by a difference according to the income levels of citizens. However, he did not go to a free housing application in any way. The institution, which is one of the principles that dominate the administrative law, which is expected to work in the framework of the principle of "public benefit" in the provision of public services, is also the main question of this study, how much the principle of public benefit is observed in the provision of housing, especially for the middle and low-income groups. The proposal of the hypothesis created in this sense is: Government and public institutions act according to the principle of public benefit in service offers. The study, which was completed in 2011 and distributed to the rights owners identified in the same year, the Crime Second Stage, 3+1, 120 square meters of residential area of 228 apartments (10 buildings), a comparison between the cost of the TOKİ and the cost of the citizen, a public point of view, is aimed at revealing whether "winning or public benefit has occurred". This work consists of three sections. In the first part, the short history and practices of TOKİ, in the second part, the concept of "public benefit" and in the third part, the work was concluded with a general assessment of the land supply, the production and sale stage of TOKİ Housing, accompanied by figures and calculations.
