Bu yazının amacı Türkiye’de sağlık hakkının güvence altına alınmasında sunulan temel kamu hizmeti olan sağlık hizmetine erişimde alınan katılım pa- yının anayasaya uygunluğu tartışılmasıdır. Yazıda Anayasaya aykırı bir yüküm- lülük olduğu iddia edilen bu katılım payı konusunda Anayasa Mahkemesinin içtihatları okunmaya çalışılmıştır. Katılım payının Anayasamızın 73.maddesinde düzenlenen vergi ödevi kapsamında olan bir yükümlülük olduğu ve yasallık ilkesine aykırı olarak Sosyal Güvenlik Kurumuna geniş yetki verildiği konusunda Anayasa Mahkemesine açılan iki dava dolayısıyla Yüce Mahkeme katılım payının Anayasaya uygun ol- duğu kararına varmıştır. Bir kamu hizmeti olduğu tartışmasız olan sağlık hiz- meti karşılığı alındığı pay ödenmeden hizmetten yararlanılmasının mümkün olmadığı, katılım payının harç benzeri olarak görülebileceği, yasaya dayanarak bir kamu idaresi olan SGK tarafından alındığı dikkate alınırsa bu gerekçenin oldukça tartışmalı olduğu ifade edilebilir. Yüce Mahkemenin ilk ve ikinci kararında katılım payının uluslararası söz- leşmelere göre de alınabileceği gerekçesi de, Türkiye’de bu katılımın oldukça yüksek bir oranda sağlık sigortası primleri ile yapıldığı gerçeği karşısında geçerli değildir.
The purpose of this article is to discuss the conformity of the participation in access to health services, which is the basic public service offered in Turkey in the protection of the right to health. In the text, it was attempted to read the Constitutional Court's allegations on this part of participation claimed to be a violation of the Constitution. The participation share is a duty within the scope of the tax duty set out in Article 73 of our Constitution and the lawful principle violates the extensive authority given to the Social Security Institution due to the two cases opened to the Constitutional Court that the participation share of the Supreme Court has reached the decision to be in accordance with the Constitution. If it is considerable that a public service is a public service, it is not possible to take advantage of the service without paying the share of the health and text, the share of the participation can be seen as the same as the fee, and it is taken by the SGK, which is a public administration based on the law, this reason can be stated that it is quite controversial. The reason that the participation in the first and second judgment of the Supreme Court can also be taken according to international conventions is not applicable against the fact that this participation in Turkey is made with a fairly high rate of health insurance premiums.
