XII. yüzyılda yaşamış Hanefî fakihlerinden olup, kendisinin “sahih” olarak değerlendirdiği görüşlerin diğer Hanefi âlimlerin görüşlerine tercih edilebileceği söylenen ve âlimlerin görüşlerini zikrederken yaptığı değerlendirme ve tercihlerle “mesâilde müctehid” grubuna sokulan Kâdîhan’ın (ö. 592/1196) Fetâvâ’sı, el-Fetâva'l-Hâniyye veya sadece el-Hâniyye olarak da bilinip Hanefî mezhebinin en fazla itibar edilen fetva kitaplarından birisi olmuştur. Osmanlı şeyhülislâm ve müftülerinin de fetvalarını verirken görüşlerine mesnet teşkil edecek nakilleri getirdikleri eserlerin başında Kâdîhan’nın Fetâvâ’sı gelmektedir. Bu çalışmada Kâdîhan’ın söz konusu eserinde, Hz. Peygamber (s.a.v.) zamanından beri tartışılan ve günümüzde de tartışma konusu olmaya devam eden aynı zamanda insanlığın ilk gününden beri dinî ve/veya din dışı amaçlarla doğumdan ölüme kadar hayatın her safhasında vazgeçilmezliğini devam ettiren mûsiki konusu ile alakalı meselelerin tespit edip değerlendirilmesi amaçlanmıştır. Neticede, mûsiki konusundaki onca müspet rivayete ve mûsiki insan ilişkisine rağmen mutlak olarak menfi düşüncelere sahip olmanın ve bu düşüncelerin kitaplarda yer almasının oluşturduğu tezat eskiden olduğu gibi bugün de insanların zihinlerini meşgul etmeye devam etmektedir.

Kâdîhan is one of the Hanafi Fiqh scholars who lived in the 12th century. It is said that the views Kâdîhan (d. 592/1196) considered as “true” could be preferred to the views of other Hanafi scholars. Thus, he was included in the group “interpreters of Islamic law issues” thanks to his analyses and preferences he made while referring to the views of scholars. Kâdîhan’s Fetâvâ, also known as al-Fatawa al-Haniyya or simply al-Haniyya, has been one of the most respected fatwa books of the Hanafi sect. Kadihan’s Fetava is a leading work to which the Ottoman shaykh al-islam and mufti referred when issuing their fatwas to form a basis for their views. In this study, it is aimed to identify and examine the issues related to music in Kâdîhan’s afore-mentioned work. Music is a subject that has been discussed since the Prophet Mohammad’s time (BPUH). It has also continued to be an indispensable part of our life from birth to death for religious and/or non-religious purposes since the first day of humanity. However, despite all positive narratives about music and the relationship between music and human being, absolute negative thoughts are formed in some books on music. Therefore, this leads to contradiction that continues to occupy the minds of people as it did in the past.
