Abstract:

Yabancı uyruklu kişilerin Türkiye’de taşınmaz edinimleri Türk hukuku uyarınca sınırlandırılmıştır. Dolayısıyla Türkiye’de joint venture türünde bir ortaklık ilişkisine giren yabancı uyruklu kişilerin durumu taşınmaz edinimi açısından önem arz etmektedir. Bu sebeple bu çalışmada yabancı ortaklı joint venture’ların -ortak girişimlerin- Türk hukuku uyarınca taşınmaz ediniminin mümkün olup olmadığı, eğer mümkün ise hangi şartlarda ve kapsamda taşınmaz edinebilecekleri ele alınacaktır. According to the Turkish law it is confined that the foreigners acquire an immovable property in Turkey. Therefore the status of foreign nationality partners who get into a joint venture partnership in Turkey is crucial regarding the immovable property’s acquisition. Due to this reason, in the following study it will be considered whether it is possible that the joint ventures with foreign nationality partners acquire the immovable property in accordance with Turkish law or not, its conditions and its scope if possible.
