Abstract:

Tehdit,çok işlenen suç tiplerindendir. Bu suç, 5237 sayılı Türk Ceza Kanunu'- nun hürriyete karşı suçlar başlıklı bölümünde düzenlenmiştir. Bu çalışmada, 5237 sayılı TCK’nın 106/2-a maddesinde yer alan silahlı tehdit suçu incelenmiştir. Tehdit suçunun silahla işlenmesi, daha ağır cezayı gerektiren nitelikli haldir. Tehdit, mağdurun iç huzurunu bozan ve güvenlik duygusunu zedeleyen bir fiildir. Dolayısıyla tehdit, kişilerin istediği gibi irade oluşturma ve oluşturduğu iradeye yönelik hareket etme hürriyetini kısıtlamaktadır.
