Abstract:

Kural’ın kendisiyle uyumlu eylemi nasıl belirleyebildiği sorusu, Wittgenstein’ın son dönem çalışmalarında merkezi bir yer tutar. Felsefi Soruşturmalar’da konuya ilişkin birden fazla cevap vardır. İlk cevaba göre kural’ın anlamını belirleyen gramerdir. İkinci cevaba göre ise anlamı belirleyen, o kural ya da sözcüğün kullanımıdır. Matematik, mantık, dil ve renklere ilişkin kurallar analitik olup kural ve uygulaması arasında bir boşluk bulunmaz. Mantık ve gramer, kurala uygun eylemi kesin bir şekilde belirler. Bu nedenle de hangi eylemin kurala uygun olduğu sorusuyla karşılaşılmaz. İhtimal ve şüphenin dışlandığı bu alanda yoruma da yer yoktur. Hukuk kuralları çoğu zaman analitik sözcük ve kavramlardan oluşmaz dolayısıyla farklı uygulamalara ve yoruma açıktırlar. Bu farklılık, Wittgenstein’ın kural kavramının, tüm hukuk kurallarını içerecek şekilde kullanılmasını engeller.

Abstract:

The question of how “the rule” determines the action which is compatible with itself holds a central place in Wittgenstein’s last term studies. There is more than one answer to related topic in Philosophic Investigations. According to first answer, what determines the meaning of rule is grammar. As to the second is what determines the meaning is usage of this rule or word. The rules related to mathematics, logics, language and colors are analytic and there is no gap between the rule and its practice. Logic and grammar exactly determine the act compatible with the rule. Therefore with the question of what action compatible with the rule is not encountered. In this area, probability and suspicion are excluded, there is no place for commend as well. Legal rules do not mostly consist of analytic words and concepts. They, thereby, are open to different practices and commends. This difference prevents the usage of Wittgenstein’s rule concept to include all legal rules.
