Niyazi Berkes (1908-1988), Türk modernleşmesi ve çağdaşlaşması ile ilgili görüşleriyle tanınan önemli bir fikir adamı ve sosyologdur. Berkes’in, çağdaşlaşma meselesini aydınlanmacı-pozitivist, modernleşmeci, batı merkezci bir paradigmadan hareketle çözümlemekte olduğu görülmektedir. Dolayısıyla söz konusu paradigmaya yönelik tüm eleştirilerin Berkes’e de yöneltilebileceğini rahatlıkla söyleyebiliriz. Onun Kur’an, Sünnet, İslam Hukuku, Tasavvuf gibi konulardaki yazıları, yer yer ilgi çekici, değerli tespitler de barındırmakla birlikte ilahiyat alanına yabancı olmanın, müsteşriklerin taraflı yorumlarına itibar etmenin ve aydınlanmacı-pozitivist din tasavvuruna sahip olmanın yarattığı çelişkiler ve sınırlılıklarla maluldür. Berkes’in İslam Hukuku’nun, dini dogmalara dayandığı için durağan bir toplum yarattığı, toplumsal değişmeye karşı, çağdaş ihtiyaçları karşılamaktan uzak olduğu gibi tespitleri bizce gerçeği yansıtmamaktadır. Fıkıh bilginleri, dinin ruhuna ve açık naslara aykırı olmayan örf ve adetleri muteber kabul etmiş, zamanın değişmesiyle hükümlerin de değişeceğini İslam Fıkhının külli kaidelerinden biri olarak tespit etmişlerdir. Onlar, verdikleri hükümlerde, kamu yararını gözetmişler, hakkında naslarda kesin bir hüküm bulunmayan konularda, dinin temel maksatlarını gözetmek kaydıyla, sosyal gerçekliği de göz önünde bulunduran içtihatlarda bulunmuşlardır.
Niyazi Berkes (1908-1988) is an important ideologist and sociologist known for his views on Turkish modernization and modernization. It appears that Berkes is moving to resolve the problem of modernization from an illuminating-positive, modernizing, western-centric paradigm. So we can easily say that all the criticism of the paradigm in question can also be directed to Berkes. His writings on subjects such as the Qur’an, Sunnah, Islamic Law, Tasavvuf, the place place also contains interesting, valuable findings; the contradictions and limitations that are created by being a stranger to the field of the gods, recognizing the side interpretations of the mysticists and possessing an enlightening-positive religious design. The findings of Berkes that the Islamic Law created a stable society because it is based on religious dogmas, against social change, as far from meeting contemporary needs, we do not think reflect the truth. The scientists have accepted the arms and orders that are not contrary to the spirit of the religion and the open assets, and they have determined that the judgments will change with the change of time as one of the religious orders of the Islamic Fight. They have observed the public interest in the provisions they have given, and in the matters of which there is no precise determination about it, they have found in the purposes of the basic purposes of religion, taking into account the social reality.
