Sözleşme özgürlüğü kapsamında taraflar sözleşmenin kapsamını ve sözleşme yapacağı karşı tarafı özgürce seçebilme hakkına sahip olmakla birlikte bu özgürlük bazı durumlarda kötüye kullanılabilmektedir. Özellikle çalışma hayatında işçiler, işveren tarafından keyfi olarak yapılan ayrımlara maruz kalmaktadır. Bu ayrımcılıklarla mücadele edebilmek için ülkeler kendi iç hukuklarında düzenlemeler yaptığı gibi uluslararası alan bu kapsamda pek çok sözleşmede yapılmıştır. Türkiye’de, uluslararası sözleşme ve belgeler ile bunları dayanak yapan anayasa ve kanunlarda eşitlik ilkesini düzenlemektedirler. Bu düzenlemeler özellikle çalışma hayatında daha yoğun olarak görmeye başladığımız kadınlarla ilgili olarak, kadın ve erkekler arasında iş hayatında ayrım yasağı olarak önümüze çıkmaktadır. Eşitlik ilkesi, eşit durumda olanların aynı haklara sahip olmasını ifade eder. Anayasa 10. maddede düzenlenmiş bulunan eşitlik ilkesi, tüm hukuk alanında ve bu arada özel hukukta geçerli olan bir ilkedir. Bu ilkenin İş hukukundaki görünümü ise “eşit davranma ilkesi” dir.
In the context of the freedom of agreement, the parties have the right to freely choose the scope of the agreement and the opposite party to conclude the agreement, but this freedom may in some cases be misused. Especially in the working life, workers are exposed to differences made by the employer. In order to combat these discriminations, the countries have made regulations in their own domestic law, as the international field has been made in this scope in many treaties. In Turkey, they regulate the principle of equality in international treaties and documents and in the constitutions and laws that are based on them. These regulations appear in front of us as a ban on discrimination between women and men in the workplace, especially with regard to women that we are beginning to see more intensely in the workplace. The principle of equality means that those in equal conditions have the same rights. The principle of equality established in Article 10 of the Constitution is a principle applicable in all the fields of law and, at the same time, in private law. This principle appears in the Labour Law as "the principle of equal behavior".
Within the scope of freedom of contract, parties have freedom to choose contract’s scope and the party who will make contract with, but this freedom can be abused sometimes. Workers treated arbitrary discrimination by employer especially in labour life. To cope with this discrimination, countries have made domestic regulations and many international treaties have been made. Equality principle is regulated in codes and constitution which based on international treaties in Turkey. This regulations are more about women who can be seen more often in labour life and especially about discrimination prohibition in labour life between women and men. Equality principle means people in equal stiation have same rights. Equality principle which regulated in constitution article 10 is a general principle which is valid to whole law area and also private law. This principle shows itself as “equal conduct principle” in labour law.
