Abstract:

Anayasa Komisyonu’nda görüşülerek 21 maddeden 18 maddeye indirilen anayasa değişikliği teklifi esas itibariyle hükümet sistemi değişikliğini amaçlıyor. Bu anlamlı ve gerekli bir arayış, çünkü Türkiye uzunca bir süre sapkın bir parlamenter sistem sahipti ve Ağustos 2014’ten bu yana hiçbir hükümet sistemine sahip değil. Ancak, yargıyla ve yargı üst kuruluyla ilgili bazı müspet değişiklik önerilerine rağmen bu teklifin kuvvetler ayrılığını güçlendirmesi söz konusu değil. Bu bakımdan önceki duruma göre değişen bir şey yok. Meclis’ten geçse ve referandumda halk onayı alınsa bile bu teklif ülkenin anayasa ve hükümet sistemi problemini çözmeyecek ve ilgili tartışmalar, arayışlar devam edecek

A Short Overview On The Amendment Of Constitution

Abstract:

Amendment of the constitution that was discussed in Constitutiıonal Commission of the Parliamentary where the amendment was diminished to 18 articles from 21 aims to change governmental system fundamentally. Since Turkey has had an obsessive parliamentary system for a long time the amendment seems a significant and a necessary quest. Besides, Turkey hasn’t had any gover-nmental system since August 2014. Although the amendment includes some positive reforımations on judiciary and supreme council of justice, it doesn’t strengthen checks and balances system. There will be no change in comparison with previous situation. Even the amendment will be passed by the parliament and will be approved by the society via referendum, it will not able to solve constitutional and governmental problems of the country and eventually relevant arguments and the quest will go on
