Modern hayatta kültürel kodların, toplumsal yaşamın ve ihtiyaçların değişmesiyle hukuk da evrilmekte ve güne uygun çözümler üreterek adalet dengesini sağlamaya çalışmaktadır. Liberal ve bireyci hukuk sistemlerinin vazgeçilmez ilkesi sözleşme özgürlüğü de Sanayi Devrimi ile başlayan süreçte birçok yönden sınırlandırılarak hukuk evrimine katılmıştır. Bu çerçevede, ilk kez 6098 sayılı Türk Borçlar Kanunu’nun genel hükümler içinde altı madde halinde yasal zemine kavuşturmasıyla pozitif hukukumuzda yer alan genel işlem koşullarının denetiminin sözleşme özgürlüğünü neden ve nasıl kısıtladığının tespiti gerekir. Çalışmada genel işlem şartlarına ilişkin Türk Borçlar Kanunu’nun getirdiği denetim türlerinin sözleşme özgürlüğü ilkesi ile ilişkisi ele alınmıştır.
In modern life, the law is evolving parallel to the change in cultural codes, community life and needs and trying to equilibrate justice with finding modern solutions. Freedom of contract which is an indispensable principle of liberal and individualist law systems, has been limited in many ways during the process starting with the Industrial Revolution and contributed to the evolvement of law. Within this scope, it is necessary to determine why and how does auditing general terms and conditions which is recently regulated for the first time in six articles in Turkish Code of Obligations No.6098, limit the freedom of contract. Study mainly focuses on the relationship between the rules about auditing general terms and conditions in Turkish Code of Obligations and the principle of freedom of contract.
