Abstract:

Turkey has faced the problems of the protection, return and integration of the rights and freedoms of refugees who come to our country as a result of the mass refugee movement that has emerged in Syria since 2011 to this day as a result of internal confusion. The provisional protection institution for refugees from Syria to our country has been adopted, these refugees are subject to a separate legal regime. One of the most important issues for the Syrians with a temporary protection status is unfortunately the access to work rights and the business market. Thousands of refugees who have been forced to leave their countries and have been trying to maintain their lives in our territory for a decade, uncertainty and emptiness in the legislation, may have a very limited access to the right to work due to serious errors in the practice. The Syrian temporary protection status holders are subject to the system of the Law on Foreigners and International Protection, No. 6458 of April 11, 2014 and No. 6735 of July 28, 2016 and the International Labour Act. The work permit system for temporary protection status holders with a very limited specific regulation on their rights in the first years after mass asylum; the temporary protection regulation published on 22 October 2014 and the temporary protection regulation published on 15 January 2016 have been subject to some special regulation on the work permit of foreigners provided.
