Bu çalışmanın amacı çocuk adalet sistemi kapsamında suça sürüklenen çocuklara yönelik uygulamaların çocuğun psiko-sosyal gelişim özelliklerine ve çocuk hakları ilkelerine uygun olarak yerine getirilip getirilmediğini çocukların ve alanda çalışanların görüşlerinin alınması yoluyla anlamaya çalışmaktır. Araştırmada nitel araştırma yöntemi kullanılmıştır. Çocuk adalet sisteminin çok disiplinli yapısı nedeniyle örneklem seçiminde amaçsal yaklaşım kullanılmış ve maksimum çeşitliliğin sağlanmasına özen gösterilmiştir. Araştırma kapsamında yarı yapılandırılmış görüşme formu kullanılarak veriler toplanmıştır. Verilerin analizinde tümevarımcı bir yaklaşımla NVivo Nitel Veri Analizi Programı’ndan yararlanılmış ve katılımcıların görüşleri doğrultusunda öncelikle ortak kavramsal kodlar oluşturulmuş, sonrasında da alt tema ve temalara ulaşılmıştır. Araştırma sonucuna göre çocuk adalet sistemi uygulamalarında refah yaklaşımı yerine cezalandırma yaklaşımının benimsendiği adli kolluk, soruşturma, kovuşturma ve ceza infaz aşamalarında çocuk haklarına ve çocuğun psiko-sosyal gelişimine uygun davranılmadığı, sistemin çocukları yeniden toplumsallaştırmada yetersiz kaldığı, müdahaleye rağmen çocukların suç işlemeye devam ettiği anlaşılmıştır.
The objective of this study is to try to understand whether the practices against the infants who are committed to crime within the framework of the child justice system are fulfilled in accordance with the characteristics of the child’s psychosocial development and the principles of the rights of the child and the opinions of children and workers in the field. The research method has been used. Due to the multidisciplinary structure of the child justice system, a target approach has been used in the selection of samples and the maximum diversity has been carried out. In the framework of the research, the data was collected using a semi-configured interview form. The NVivo Qualitative Data Analysis Program has been used with a thorough approach to data analysis and, in accordance with the opinions of the participants, common conceptual codes have been created first and then sub-themes and sub-themes have been reached. According to the research, the approach of punishment was adopted in the practice of the child justice system instead of the welfare approach; the child rights and psychosocial development were not treated in the judicial law, investigation, prosecution and punishment stages; the system was insufficient in re-socializing the children; the child continued to commit crime despite the intervention.
The aim of this study is to understand whether practices towards juvenile delinquents in the juvenile justice system are relevant to psychosocial development characteristics of children and principles of children's rights through analysing judicial decisions and getting opinions of children and professionals. Qualitative research method was applied in the present study. Due to multi-disciplinary structure of juvenile justice system, teleological approach was used in selecting samples, and maximum diversity was ensured to include. Data was collected through using semi-structured interview form. Data was transcribed and computerised. NVivo qualitative data analysis software was used in analysing data through inductive approach, and firstly conceptual codes were generated then themes and sub-themes were reached according to participant views. Study results show it is found out in juvenile justice system that retributive approach was assumed instead of welfare approach; children are not treated pertinent to their rights and psychosocial development in the stages of judicial police, investigation, prosecution and punishment execution; the system fails to satisfy resocialization of children; despite the intervention, delinquency continues among children.
