Bu makalede son devir Osmanlı hukukçularından olan Küçük Ali Haydar Efendi’nin (ö. 1354/1935) şurût ilmine dair yazdığı eserler incelenecektir. Ali Haydar Efendi Osmanlı Devleti’nin son döneminde yetişmiş büyük bir hukukçudur. O, devlette üstlendiği birçok hukukî vazifenin yanı sıra İslâm hukukuna dair birçok eser kaleme almıştır. Yazdığı bu eserler hukuk ilmine birçok katkı sağlayıp ardından gelen hukukçular için de ilham kaynağı olmuştur. Ayrıca Ali Haydar Efendi hem medrese kökenli bir âlim hem de Tanzimat sonrası kurulan eğitim kurumlarında yetişmiş bir hukukçudur. Ali Haydar Efendi’nin eserleri tüm bu hususlar dikkate alınarak değerlendirilmelidir. Ali Haydar Efendi’nin bu makalede inceleyeceğimiz eserleri şurût ilmine dair kaleme alınmış son eserlerdir. Bu eserler Tatbikât-ı Şer’iyye Dersi ve Kitâbü’l-mebâhisi’l-mühimme fi’t-tatbikât-ı şer’iyye ve’l-hukukiyyedir. Bunlardan Tatbikât-ı Şer’iyye Dersi daha önce yazılmış olup diğer eserin temelini teşkil etmektedir. Bu kitap, Ali Haydar Efendi’nin medresetü’l-kudâtta verdiği tatbikat-ı şer’iyye dersinde ders kitabı olarak okuttuğu bir eser özelliği taşımaktadır. Diğer eseri olan Kitâbü’l-mebahisi’l-mühimme fi’t-tatbikât-ı şer’iyye ve’l-hukukiyye ise Ali Haydar Efendi’nin uzun yıllar üzerinde çalıştığı ve tatbikât alanına (Ali Haydar Efendi döneminde şurût ilminin adı tatbikât olmuştur) dair orijinal bilgilerin yer aldığı ve de şurût ilmine dair kaleme alınan son kitaptır. Bundan ötürü Osmanlı döneminde şurût ilminin Ali Haydar Efendi ile sona erdiğini söylemek mümkündür.
Abstract In this article, I will analyze Ali Haydar Efendi's (d. 1354/1935) books on ilm al-shurūt. Ali Haydar Efendi was one of the great legal experts who was trained in the last period of the Ottoman Empire. He wrote several books on Islamic law in addition to his legal services in the State. His books have made significant contributions to the science of law and have been an inspiration to the following legal experts. Besides, Ali Haydar Efendi was both trained in madrasa and educational institutions which were established after the Tanzimat. Ali Haydar Efendi's books should be evaluated by considering all these aspects. The books that I will analyze in this article are the last books written in the field of ilm al-shurūt. These books are The Book of the Holy Spirit and the Book of the Holy Spirit and the Book of the Holy Spirit and the Book of the Holy Spirit and the Book of the Holy Spirit. From these books The Coursebook was written earlier and this was the basis of the other book. This book was the coursebook for the lesson of Exercise of Shariyyah which was lectured by Ali Haydar Efendi in madrasah al-qudat. Ali Haydar Efendi had studied on his other book Book al-Mabahis al-Muhimmah fi't-Tatbikat aş-Shariyyah va'l-Hukiyyah for many years. This book contains original information about the practice (tatbikat was the name of ilm-al shurūt in the time of Ali Haydar Efendi) and so this book is the last book written about ilm al-shurūt.
