Bu çalışma, hem Hanefîlere hem de Mâlikilere göre istihsân teorisini ve istihsânın konularının Makâsıdu’ş-Şerîʿa ile bağını açıklamayı amaçlamaktadır. Ayrıca Mâliki Mezhebinin bu alandaki meşhur rolü yanında, hüküm verirken Makâsıd düşüncesini esas alma hususunda Hanefî Mezhebinin (hakettiği şekilde öne çıkarılmayan) rolü gösterilmeye çalışılmıştır. Bu yüzden ilk olarak makâsıdın kelime ve terim manaları üzerinde durulmuş, ardından her iki mezhep alimlerinin tarihsel kronolojisi de dikkate alınarak, Hanefî ve Mâliki mezheplerinde istihsânın zaman içerisinde kazandığı anlam ve boyutların gelişimi ortaya konulmaya çalışılmıştır. Mâliki ve Hanefî mezheplerinin hem ilk dönem hem de daha sonraki dönem alimlerinin, istihsânın hücciyyeti ile ilgili olarak ileri sürdükleri deliller değerlendirilmiş ve istihsânın kısımlarından bahsedilmiştir. Son olarak, İstihsân bahisleri ve makâsıdu’ş-şerîʿa arasındaki ilişkinin mahiyeti beyan edilmiş, her iki mezhebin furuʿ fıkhından, istihsânın makâsıdu’ş-şerîʿaya ne denli dayalı olduğunu ve ona hizmet ettiğini gösteren örneklerle çalışma bitirilmiştir. Bu çalışmanın sonucu ise şudur: İstihsan, genel ve yerleşik kuralların tatbik edilmesi halinde Şeriat’ın maksat ve hedeflerinden sapmanın söz konusu olacağı durumlarda; maslahat ve adaletin tezahürü mahiyetindeki makâsıdu’ş-şerîʿaya dönmektir.
This study aims to explain both the Hanefîs and the Mâlikîs according to the theory and the connection of the subjects of the Hanefîs with the Makâsûd-şerîâa. In addition to the famous role of the Mâliki Mezhebinin in this area, it was tried to show the role of the Hanefî Mezhebinin (not prompted as it was judged) on the basis of the Makâsid thought. For this reason it was first focused on the word and term meanings of the makassy, then the historical chronology of both disciples was taken into account, and in the Hanefî and Mâliki disciples it was tried to reveal the meaning and dimensions of the development of the consciousness in time.
