In Turkish law, there are some consequences linked with the violation of sexual fidelity obligation between the married persons. It’s controversial in the trial practices and doctrine points that if person facing with such infidelity or with common usage "cheated spouse" might claim nonpecuniary damages against third person within the said relation or not. The subject became a current issue again together with controversial decisions recently given by Court of Appeals. Purpose of this paper is to put forward the theoretical bases the jurisdiction will hold on acceptance or rejection of such claims for damages
