Yükseköğretim kurumları ile öğrenci arasındaki ilişkinin sürdürülmesindeki en önemli konulardan birisi öğrenci disiplin rejimidir. Yükseköğretim kurumu içindeki düzenin sağlanabilmesi bakımından öğrencilerin çeşitli kurallara tabi olması zorunludur. Bu bağlamda gelişen öğrenci disiplin rejimi, 2547 sayılı Yükseköğretim Kanunu çatısı altında düzenlenmiştir. Yükseköğretim kurumlarında ilişiği kesilmiş öğrenciler hakkında disiplin soruşturması açılabilmesi kapsamında 2547 sayılı Kanun, 2023 yılında yapılan değişiklik ile bu duruma bir açıklık getirmiştir. Kanunun 54/6-d maddesi kapsamında her ne sebeple olursa olsun ayrılan kişiler hakkında disiplin soruşturmasının açılması, yürütülmesi ve tamamlanması zorunluluğu bulunmaktadır. Ancak soruşturma sonucu verilecek kararların uygulanması bakımından öğrencilik statüsü devam etmeyen kişilerin durumunun da göz önüne alınarak incelenme yapılması gereği doğmaktadır. Bu çalışma ile ilişik kesme türleri belirlenerek, disiplin soruşturması başlatılan ilişiği kesilmiş öğrenciler hakkında alınacak disiplin cezası kararlarının uygulanabilirliğinin ortaya konulmasına çalışılacaktır. Bu kapsamda ortaya çıkan çeşitli olasılıkların getirdiği hukuki problemlere de çözüm önerileri getirilmesi hedeflenmektedir.
One of the most important subjects in establishing the relation between higher education institutions and students is the student discipline regime. In order to ensure the order within the higher education institution, students must be subject to various regulations. The developing student discipline regime has been regulated under the umbrella of the Higher Education Law No. 2547. Law No. 2547 clarified the opening a disciplinary investigation against dismissed students in higher education institutions with the amendment regulated in 2023. Within the scope of Article 54/6-d of the Law No. 2547, it is obligatory to open, conduct and complete a disciplinary investigation against former students who have left for whatever reason. However, in terms of the implementation of the decisions to be made as a result of the investigation, it is necessary to examine the situation of the people whose student status does not continue. In this study, the types of dismissal will be determined and the applicability of the disciplinary punishment decisions to be taken against the dismissed students will be tried to be revealed. In this context, it is aimed to propose solutions to the legal problems brought about by various possibilities.
