The competence of the European Community on the conclusion of international agreements in the field of private international law has been subject to much comment in recent years. Discussions have centered on the question of whether the European Community has exclusive competence on the conclusion of the revised version of the Lugano Convention of 16 September 1988 on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters. The Council of the European Union has applied to the Court of Justice of the European Communities for an opinion, which could only be declared after three years. The Lugano Opinion is significant, not only in solving the problem of the conclusion of the new Lugano Convention by the European Community, but also regarding jurisprudence of the Court of Justice on the exclusive external Community competence and the future developments in the field of European private international law
