Abstract:

The legal proceedings law and the international arbitration law are discussed. According to the Constitution of the Republic of Turkey p. 90/5 the international agreements which have been enforced in accordance with the procedure are under the law and have a very important place in the Turkish law. This is why the validity of these agreements is of importance. The European Geneva Convention on Commercial Arbitration, the Convention on the Resolution of Investment Disputes between States and Citizens of Other States (ICSID), the New York Convention on the Recognition and Recognition of Foreign Arbitration Decisions and the World Intellectual Property Organization (WIPO). In these agreements there are arrangements on the issue of arbitration. In this study, it will first focus on the concept of arbitration and the arbitration contract. The advantages of international arbitration will be referred to in the International Arbitration Law. The following will be provided with detailed information on the subject of the International Arbitration Law (compatibility). The subject will also be explained in the context of the judgment, if the opinions in the teaching are needed.
