Anayasa yargısının yargılama usulleri, genellikle, heyetler halinde çalışmaya ve görüşme, oylama ve oyçokluğuyla karar alma esaslarına dayalıdır. Oylama sonucunda oyların eşitliği durumunun ortaya çıkması, halledilmesi gerekli bir meseleye yol açmaktadır: Karşıt yöndeki oylar eşit sayıda olduğunda, mahkemeler nasıl bir yol izleyecektir veyahut, nasıl bir karara varıldığı kabul edilecektir? Bu yazıda, ilkin karşılaştırmalı hukuk bakış açısıyla anayasa yargısında oyların eşitliği üzerinde durularak bu meseleye yönelik olarak getirilen farklı yaklaşımlar ele alınmaktadır. Ardından, Türkiye örneğine bakılarak, Anayasa, Anayasa Mahkemesi İçtüzüğü ve 6216 sayılı Kanunla belirlenen çerçeve içinde oyların eşitliğine yönelik olarak getirilen çözüm incelenmekte ve Anayasa Mahkemesinin konuya ilişkin içtihadı ile uygulamasından örnekler ortaya konulmaktadır.
The judgment procedures of the Constitutional Court are usually based on the principles of working in delegations and making decisions through consultation, voting and voting. The emergence of the status of equality of votes as a result of the vote leads to a matter necessary to resolve: when the votes in the opposite direction are equal, what path will the courts follow; or, what decision will be accepted? This article discusses the different approaches to this issue, focusing on equality of votes in the constitutional court from the first comparative legal perspective. Then, considering the example of Turkey, the solution brought towards equality of votes is examined within the framework established by the Constitution, the Constitutional Court Regulation and Law No. 6216 and the examples of the application of the Constitutional Court on the subject are shown.
