Yürütme organı tarafından gerçekleştirilen faaliyetlerin bağımsız yargı organları tarafından denetlenmesi, hukuk devleti ilkesinin bir gereği olarak kabul edilmektedir. Yürütme organının yargısal denetimine ilişkin olarak “yargı ayrılığı sistemi” ve “yargı birliği sistemi” olmak üzere benimsenen iki sistem olduğu söylenebilir. Her iki sistem de hukuk devleti ilkesine uygun olmakla birlikte yargı ayrılığı sisteminin benimsenmiş olması durumunda, bu sistemin doğasından kaynaklanan bir takım hukuki sorunların ortaya çıkması kaçınılmaz olmaktadır. Çalışmada, yargı ayrılığı sisteminin uygulanması dolayısı ile meydana gelen hukuki sorunların adil yargılanma hakkına olan etkileri, Anayasa Mahkemesi tarafından verilen bireysel başvuru kararları ışığında incelenecektir.
The supervision of the activities carried out by the executive body by independent judicial bodies is considered a requirement of the rule of law. It can be said that the executive body has two systems adopted in relation to judicial supervision, the "system of separation of jurisdiction" and the "system of union of jurisdiction". If both systems are in accordance with the principle of the rule of law, but the system of judicial separation is adopted, it is inevitable that a series of legal problems arise due to the nature of this system. In the study, the effects on the right to fair trial of legal issues arising from the application of the system of judicial separation will be examined in the light of the individual application decisions made by the Constitutional Court.
