Abstract:

Positive measures aim to truly ensure equal luck and equal rights, that is, to eliminate actual inequalities in social reality and to promote the lack of represented gender. Getting a woman advantageous in order to close the gap of equality does not create a different behavior in the sense of discrimination prohibitions. The "Principle of Equal Rights for Different Genders" legalizes the limitation of the fundamental right to equal treatment through quota regulations. As the quota arrangements aimed at bringing women’s representation in political decision-making bodies, directly or indirectly, to their proportion in the general population and eliminating actual inequality, can be provided by “law” as these arrangements may be included in “party regulations”.
