Ticaretin elektronik ortama taşınmasıyla birlikte sınır ötesi bir hal alan elektronik ticaretten kaynaklanan uyuşmazlıkların sayısında da ciddi bir artış yaşanmıştır. Ancak mevcut geleneksel uyuşmazlık çözüm yöntemleri elektronik ticaretten kaynaklanan uyuşmazlıkların çözümünde değişen ihtiyaçlara cevap verememektedir. Olası bir uyuşmazlık halinde etkin bir uyuşmazlık çözüm mekanizmasının varlığına ilişkin endişeler ve uyuşmazlığın nasıl çözümleneceğine ilişkin belirsizlikler özellikle tüketicilerin elektronik ticaret işlemlerine taraf olmalarının önünde engel teşkil etmektedir. Halbuki olası bir uyuşmazlık durumunda sözleşme ilişkileri bakımından zayıf konumda olan tüketicilerin haklarının korunması büyük önem arz eder. Bu kapsamda özellikle tüketiciler nezdinde güvenin inşası ve elektronik ticaret potansiyelinin tam anlamıyla kullanılabilmesi için elektronik ticaretten kaynaklanan uyuşmazlıkların etkin ve hızlı bir şekilde çözüme kavuşturulması gerekir. Bunun için elektronik ticaretin kendine has özellikleriyle uyumlu ve bu alandaki ihtiyaçları karşılayan yeni bir uyuşmazlık çözüm sistemine ihtiyaç olduğu açıktır. Bu kapsamda elektronik ortamda akdedilen tüketici sözleşmeleri için devlet yargılamasına ve hatta geleneksel alternatif çözüm yollarına da alternatif çözüm yolları arayışı gündeme gelmiştir. Çevrimiçi alternatif uyuşmazlık çözüm yolları ve özellikle elektronik tahkim devlet yargılamasına ve geleneksel alternatif uyuşmazlık çözüm yollarına alternatif olarak bu ihtiyaçların ve arayışların sonucu olarak ortaya çıkmış bulunmaktadır. İşbu çalışmanın odak noktasını da yabancı unsurlu elektronik tüketici sözleşmelerinden kaynaklanan uyuşmazlıkların çözümünde karşılaşılan sorunlar ve bu tür uyuşmazlıkların çözümünde kullanılmak üzere çevrimiçi alternatif uyuşmazlık çözüm yöntemleri ve özellikle elektronik tahkim oluşturmaktadır.

The number of disputes caused by electronic trade, which is a cross-border state, has also significantly increased. However, the existing traditional dispute resolution methods are unable to meet the varied needs in the resolution of disputes arising from e-commerce. The concerns about the existence of an effective dispute resolution mechanism in the event of a potential dispute and the uncertainty about how the dispute will be resolved, in particular, prevent consumers from being a party to electronic trade processes. However, in the event of a potential dispute, the protection of the rights of consumers who are in a weak position in terms of contractual relationships is of great importance. In this context, it is necessary to effectively and quickly resolve disputes arising from e-commerce in order to build confidence in particular with consumers and to make full use of the e-commerce potential. To do this, it is clear that e-commerce needs a new dispute resolution system that is compatible with its own characteristics and that meets the needs in this area. In this context, the search for alternative solutions for consumer contracts signed in the electronic environment has come to the rule of law and even the traditional alternative solutions. The online alternative dispute resolution methods and in particular electronic arbitration have emerged as a result of these needs and searches as an alternative to state trials and traditional alternative dispute resolution methods. The focus of this study is also the online alternative dispute resolution methods and in particular electronic arbitration for the resolution of disputes arising from electronic consumer contracts with foreign elements and for the resolution of such disputes.

With the mobilization of trade to the electronic environment, there has been a significant increase in the number of disputes arising from E-commerce. However, current traditional dispute resolution methods cannot respond to evolving needs to resolve such disputes. The uncertainties about resolving possible disputes and the concerns about an effective way to exercise their right to seek remedies causes consumers to take a distant stance toward E-commerce. Therefore, protecting the rights of consumers (in case of a possible dispute) is important. In order to increase consumer confidence in E-commerce and use the existing E-commerce potential entirely, there should be an effective and rapid dispute settlement mechanism to resolve disputes arising from E-commerce. It is clear that there is a need for a new dispute resolution system that is compatible with the unique features of E-commerce. As such, the search for alternative dispute resolution methods for the disputes arising from electronic consumer contracts has come to the agenda. Online alternative dispute resolution methods, and electronic arbitration, have emerged due to the need for alternatives to litigation and traditional alternative dispute resolution methods. This study analyzes the problems encountered in the resolution of disputes arising from cross-border electronic consumer contracts and electronic arbitration as an online alternative dispute resolution method to be used for such disputes.
