Üretimi meydana getiren insan gruplarına çalışanlar denilmektedir. Çalışanlar, başkalarına bağımlı olarak çalışabildikleri gibi bağımsız olarak da çalışabilirler. Bağımlı çalışanlar, üretime genellikle sadece emeği ile katkıda bulunan ve işverenlere bağlı olarak çalışan kişilerdir. Bağımsız çalışanlar ise başkasına bağımlı olmadan kendi adına çalışan kişilerdir. Hem iş akdinin tarafı hem de akit konusu işi yapacak kişi olması itibarıyla iş akdinin en önemli unsuru olan çalışan, İslam hukukuna göre ecîr-i hass ve ecîr-i müşterek olarak iki kısma ayrılmaktadır. İşveren ise iş akdinin işçiye göre diğer tarafı veya ücretle başkasını çalıştıran kişidir. İslam hukukunda çalışanların uygun bir işte ve uygun koşullarda çalışma, izin ve dinlenme, dinî ihtiyaçlarını karşılama ve verdiği emeğin karşılığında ücret almak gibi hakları bulunmaktadır. İslam, hangi sosyal kesimde olduğuna bakmaksızın kişiye güç ve kabiliyetine uygun bir işte çalışma hürriyeti ve hakkı tanımıştır. Akit konusu işin, ifasının mümkün ve çalışanın gücü ve kontrolü dâhilinde bulunması gerekmektedir. Dinlenme, bedensel yorgunluğun giderilmesidir. Dinlenme, insanın çalışma gücünün yeniden kazanılması için fıtri bir mecburiyet olup çalışanın dinlenme hakkı, iş hukukuna hâkim olan işçiyi koruma ilkesinin bir sonucudur. İşverenin çalışanına namaz kılmak için izin vermemesi durumunda çalışanın, namazlarını ne şekilde ve nasıl kılacağı hususunda farklı görüşler mevcuttur.
