Bu çalışmanın amacı, Türk eğitim sisteminde eğitim hakkı ihlallerinin nedenlerine ilişkin öğrenci ve öğretmen görüşlerini belirlemektir. Nitel araştırma yöntemlerinden durum çalışması deseni ile tasarlanan bu çalışma kapsamında 25 öğrenci ve 25 öğretmenden oluşan 50 katılımcıyla görüşmeler yapılmıştır. Görüşmelerden elde edilen veriler MAXQDA 2020 programıyla tematik olarak analiz edilmiştir. Çalışma sonucuna göre Türkiye’de eğitim hakkı kapsamında eğitime erişim, eğitimde fırsat eşitliği, nitelikli eğitim ve öğrenme ortamında saygı görme hakkına ilişkin hak ihlalleri yaşanmaktadır. Bu hak ihlallerinin nedenleri arasında sosyoekonomik düzeyin düşük olması, okula ulaşımda sorunlar yaşanması, okulda fiziki yetersizliklerin bulunması, cinsiyet gibi çeşitli nedenlerle ayrımcılığa uğrama, devlet okulu ve özel okullar arasında imkân farklılıklarının bulunması, nitelikli öğretmen, araç ve ortam eksikliği ve zorbalığa maruz kalma öne çıkmaktadır. Bu hak ihlallerinin önlenmesi için sosyoekonomik eşitsizliklerin azaltılması, eşitlikçi eğitim politikalarından sosyal adaleti temel alan eğitim politikalarına geçilmesi, öğretmen ve okul ortamının niteliğinin arttırılması ve zorbalığı önlemeye yönelik adımların atılması önerilmektedir.
The aim of this study is to identify student and teacher opinions on the reasons behind violations of the right to education in the Turkish education system. Designed with a case study pattern using qualitative research methods, the study involved interviews with 50 participants, consisting of 25 students and 25 teachers. The data obtained from these interviews were thematically analyzed using the MAXQDA 2020 program. According to the study's findings, there are violations of the right to education in Türkiye, encompassing issues such as access to education, equal opportunities in education, quality education, and respect in the learning environment. Some of the identified causes of these violations are low socioeconomic status, transportation issues affecting school access, physical inadequacies within schools, discrimination based on various factors such as gender, disparities in opportunities between public and private schools, lack of qualified teachers, inadequate resources and facilities, and exposure to bullying. To prevent these rights violations, it is recommended to reduce socioeconomic inequalities, transition from egalitarian education policies to those based on social justice, enhance the quality of teachers and the school environment, and take proactive measures to prevent bullying.
