Gümrük kabahatlerinde sorumluluk halleri

Abstract:

Gümrük kabahatleri için parasal nitelikte idari yaptırımlar öngörüldüğünden, bu kabahatler, başta mülkiyet hakkı olmak üzere, İnsan Hakları Sözleşmesi ve Anayasa’da yer alan temel hak ve özgürlüklerle yakından ilgilidir. Dolayısıyla, gümrük idaresinin, idari yaptırımları uygularken, sorumluları doğru bir şekilde tespit etmesi oldukça önemlidir. Diğer taraftan, gümrük kabahatleri bir dönüşüm süreci getirmiş ve 5326 sayılı Kabahatler Kanunu’nun genel hükümleri, gümrük kabahatleri bakımından da geçerli hale gelmiştir. Bu çalışmada, gümrük kabahatlerinde sorumluluk konusu, yerel mevzuat hükümleri ve yargı kararları ışığında incelenmeye çalışılmıştır.
