Abstract:

 Medeni yargılama hukukunda klasik ilkeler liberal dünya görüşüne dayanmaktadır. Günümüzde medeni yargılamanın işlevi anayasa hukuku kaynaklı adaleti temin talebi ile açıklanmaktadır. Modern usul hukuklarında yargılamanın hızlandırılması amacıyla da hakimin etkinliğini artıran hükümler getirilmiştir. Davada tarafların rolü ve yargılamanın hızlandırılması bir gerilim ilişkisi içerisindedir. Çalışmada usul ilkeleri bu açıdan ele alınmaktadır.

classic principles in civil judgment law are based on liberal world opinion, today the function of civil judgment is explained by the demand of provision of constitutional law-borne justice, in order to speed up judgment in modern procedural law, the provisions that increase the effectiveness of the judge in order to increase the parties’ role and the speed of judgment in a tension relationship is discussed in this respect
