ÖZET Bu çalışmanın amacı sözleşme aracı olarak dinsel ve dinsel olmayan yeminleri din sosyolojisi bağlamında incelemektir. Bu kapsamda Iğdır’da hayvan ticareti yapan yaklaşık 300 kişilik bir evrene sahip olan cambazlar hedef kitle olarak belirlenmiştir. Gözlem tekniğinin yanı sıra Weber’in “anlamacı”-“yorumcu” tekniği kullanılmış ve 12 kişiyle görüşme gerçekleşmiştir. Makalemizde yemin kavramının tanımı, Kur’an-ı Kerim’de yemin ve Hadis-i Şeriflerde yemin hususuna değinilmiş, yanı sıra yemin kavramının din sosyolojisi ile fıkıh ilmi bağlamında nerede durduğuna bakılmış ve katılımcı olarak seçilen cambazlara ilişkin bir takım açıklama ve tahlillere yer verilmiştir. Nihayetinde, çalışmamızın sonunda bir takım çıkarımlarda bulunulmuştur. Nitekim bunlardan biri, dinsel yeminlerin dinsel olmayan yeminlere göre toplumsal bir sözleşme bağlamında çok daha ikna edici olduğu yönünde olmuştur. The purpose of this study is to study religious and non-religious swears as a contractual means in the context of religious sociology. In this scope, the crabs, which have an universe of about 300 people who trade animals in Iğdır, have been identified as the target mass. In addition to the observation technique, Weber’s “comprehender”-”comprehender” technique was used and interviews with 12 people took place. In our article, the definition of the term of swear, the Qur’an-i Kerim and the Hadis-i Sheriff are referred to in the subject of the swear, as well as a set of explanations and assessments on the people who have been chosen as participants in the context of the religious sociology and fictional science. At the end of our work, a series of outcomes were found. Indeed, one of these was that religious swears were much more convincing in a social treaty context than non-religious swears.
