Abstract:

In 2005 various restrictions related to the agricultural lands were imposed by a general regulation. Since 2005 there has been changes in the Act and in 2014, a preemption right for neighboring owners was regulated. In the event that an agricultural land is not sold to either one of share-owners or to an owner of the adjacent lands, neighboring owner is titled to purchase the agricultural land primarily, as he/she has a preemption right. The purpose of the regulation is to rectify the agricultural lands to sufficient sizes. However, the regulation had been abused and mostly used as a way of buying the agricultural lands cheap. Due to the false results in the public, the regulation was revocated in 2020. The regulation removed the article but said nothing about the effects on the ongoing lawsuits and the reemption rights which were already gained according to the sales contracts made till 2020. The consequences of the revocation related to ongoing lawsuits and preemptions will be examined.
