Temel amacı kar elde etmek olan reel sektörün bankalar ve finans kuruluşlarından sağladıkları fonları, zaman zaman finansal sıkıntılar nedeniyle geri ödenmesi konusunda sıkıntı yaşamaları, banka bilançolarında sorunlu kredilerin meydana gelmesine ve artmasına neden olmuştur. Sorunlu krediler, bankaların aktifinde yer almakta ve banka sermaye yeterliliğini, karlılığını, aktif yapısını olumsuz yönde etkiliyor olması nedeniyle Bankacılık Düzenleme ve Denetleme Kurulu (BDDK) tarafından hazırlanan Bankalarca Kredilerin ve Diğer Alacakların Niteliklerinin Belirlenmesi ve Bunlar İçin Ayrılacak Karşılıklara İlişkin Usul ve Esaslar Hakkında Yönetmelik ile kredilerin sınıflandırılmasının ve kredi alacaklarının geri ödenmesi ile ilgili tahsil ve tasfiyesine yönelik düzenlemeler yapılmıştır. Kamu oyunda İstanbul ve Anadolu Yaklaşımları diye bilinen Finansal Yeniden Yapılandırma Programı ile darboğaz içinde olan reel sektörün borçlarının şartların uygun olması halinde yeniden yapılandırması imkanı sağlanmıştır. 2004 sayılı İcra ve İflas Kanunu ’nda yer alan Konkordato’da gerek alacaklıların ve gerekse borçlunun talebi üzerine gerçekleşen yasal bir düzenleme olup, bir yeniden yapılandırma sürecidir. Yapılan düzenlemeler çerçevesinde reel sektörün; vade uzatılması, anapara ve faiz alacağının bir kısmının vazgeçilmesi sonucunda her ne kadar yeni bir maliyete katlanmış olsa da vade ve ödeme kolaylığı etkisiyle işletmelerin girdiği darboğazdan çıkmasına destek olurken, faaliyetlerini devam ettirmelerine imkan sağlamaktadır.
The main goal of earning profits is that the funds provided by the real sector from banks and financial institutions have been difficult to pay back from time to time due to financial difficulties, causing the occurrence and increase of problematic loans in the bank balance sheets. Problematic loans are involved in the activities of the banks and the bank’s capital capacity, profitability, and active structure are negatively affected by the Banking Regulatory and Supervisory Board (BDDK) for the determination of the qualities of bank loans and other recipients and the regulations on the procedures and principles relating to the remunerations for them and the classification of loans and the reimbursement of the recipients. In the public game, the Financial Restructuring Programme, known as the Istanbul and Anadolu Approaches, has provided the possibility of restructuring the real sector’s debt if the conditions are in accordance. The Concordato, which is included in the Execution and Bankruptcy Act of 2004, is a legal arrangement that takes place on the request of the recipients and if necessary the debtor, and is a process of restructuring. In the framework of the arrangements made, the real sector is able to continue its activities as a result of leaving a part of the extension of the wage, home and interest, although it has a new cost, while the impact of the wage and payment facility supports the exit of the wage that entered.
