Bilindiği gibi, 1924 Anayasası, katı bir anayasa olduğu ve 103’üncü maddesiyle, “Anayasanın hiçbir maddesi hiçbir sebep ve bahane ile savsanamaz ve işlerlikten alıkonamaz. Hiçbir kanun Anayasaya aykırı olamaz” hükmünü taşıdığı halde, kanunların anayasaya uygunluğunun yargısal denetimi sistemine yer vermemişti. Anayasanın kabul edildiği tarihte, kanunların anayasaya uygunluğunun yargısal denetiminin pek az ülkede kabul edilmiş olduğu ve kanunu “genel iradenin ifadesi” sayan anlayışın hâkim bulunduğu düşünülürse, bunu yadırgamamak gerekir. Kaldı ki, böyle bir denetimin,azından teorik olarak kuvvetler birliği ilkesini ve mutlak yetkili bir meclis anlayışını benimsemiş bir anayasa ile bağdaşmayacak olduğu da açıktır.
