2011 tarihli 6102 sayılı Türk Ticaret Kanunu!nda müşterek avarya bahsi 1272- 1285. maddeler arasında düzenlenmiştir. Müşterek avarya, ortak bir deniz yolculuğuna çıkan gemi ve yükü ortak bir tehlikeden korumak için bilerek ve isteyerek yapılan olağanüstü masraf ve fedakarlıkların, gemi ve yükün tamamen veya kısmen kurtulmuşolmaları halinde, korunan değerlerle orantılı olarak yüklenilmesi olarak tanımlanabilir. Deniz ticaretinde bu paylaşıma “dispeç” adı verilmektedir. Bu çalışmada, 6102 sayılı Türk Ticaret Kanunu ile müşterek avarya bahsinde yapılan değişikliklerden bahsedile- cektir.
