Turkey, during the last decade, has signed or ratified some arbitration conventions and bilateral investment treaties. Some articles of Constitution of Turkish Republic has amended by the Law 4446 (dated August 14, 1999) in conformity with these conventions and treaties. The purpose of this paper is to assess whether this constitutional amendment can affect protection of environment by administrative courts. Towards this goal, the paper first explains the protection of environment by the administrative courts, and then summarizes previous process of the constitutional amendment. After laying this groundwork, the remainder of the paper presents an assessment of whether the constitutional amendment can affect the level of protection of environment by the administrative courts in light of subsequent developments of the constitutional amendment. It is concluded that increasing of enviromental problems in the future can not be simply connected with the constitutional amendment. Further, it is maintained that the protection of environment by the administrative courts are still possible.
